Quiet hours in North Las Vegas

Chapter 8.28 sets no citywide curfew: the general ban in 8.28.010 applies at any hour. Two of the listed examples point to 11:00 p.m. to 7:00 a.m. without being limited to it: playing a radio, phonograph or musical instrument so as to annoy or disturb people nearby, "particularly during the hours between eleven (11) p.m. and seven a.m." (8.28.020 B), and yelling, shouting, hooting, whistling or singing on the public streets, "particularly between the hours of eleven (11) p.m. and seven a.m., or at any time or place" so as to disturb (8.28.020 C). Construction, including excavation, erection, demolition, alteration or repair of any building, streets and highways, is allowed only between 6:00 a.m. and 9:00 p.m. (8.28.020 H), except in cases of urgent necessity in the interest of public health and safety and for minor construction work not creating a noise disturbance in the neighborhood; the building official may permit work between 9:00 p.m. and 6:00 a.m. if public health and safety will not be impaired and no party in interest would suffer loss or inconvenience. From April 1 through September 30, construction may begin at 5:00 a.m. (but not earlier) in a declarant-controlled common-interest community, and work on any project more than 300 feet from an occupied residential unit may begin by 5:00 a.m. (8.28.020 H.1). No other section of the chapter sets hours.

Decibel limits — or rather, the lack of them

There is no general decibel limit. Chapter 8.28 contains one number: operating a racetrack violates 8.28.020 L when the sounds emitted from motor vehicles and loudspeakers exceed 88 decibels measured from anywhere along the racetrack property boundary, using sound level meters with the A-weighting network; the City Council is to review that standard annually. Two zoning provisions outside the noise chapter set numbers for narrow uses: a short-term rental's noise levels may not exceed 65 decibels measured at the property line of the short-term rental unit (the code does not state a weighting or a time band), and the rental must also comply with the City's noise regulations as they apply to residential uses (17.20.030, short-term rental standard f); and sound from a small wind energy system under normal operating conditions may not exceed 55 dBA at the property line of any adjacent property for any period of time, except during short-term events out of the owner's control such as utility outages or severe wind storms (17.24.140). Chapter 15.36 sets outdoor-to-indoor noise level reductions of 25 and 30 decibels for buildings in the airport noise subzones; those are construction standards, not limits on neighbors. Parties, music, barking, loudspeakers and vehicles are judged by the unreasonable-noise standard, without a meter.

What the ordinance actually says

§ 8.28.010: "It is unlawful for any person to create noise or emit sound or cause the creation or emission thereof which is unreasonably loud, disturbing or unnecessary and is of such character, intensity or duration as to be detrimental to the life or health of any individual, or in disturbance of the public peace and welfare."
§ 8.28.020(B): "The playing of any radio, phonograph or a musical instrument in such a manner or with such volume, particularly during the hours between eleven (11) p.m. and seven a.m., as to annoy or disturb the quiet, comfort or repose of any persons in any office, hospital, dwelling, hotel or other type of residence or of any persons in the vicinity;"
§ 8.28.020(H): "The construction, including excavation, erection, demolition, alteration or repair of any building, streets and highways other than between the hours of 6:00 a.m. and 9:00 p.m. except in cases of urgent necessity in the interest of public health and safety and minor construction work not creating a noise disturbance in the neighborhood."
§ 8.28.020(L): "The operation of a racetrack when the sounds emitted from motor vehicles and loudspeakers exceed eighty-eight (88) decibels when measured from anywhere along the racetrack property boundary."
§ 17.20.030 (short-term rentals, standard f): "Noise levels shall not exceed sixty-five (65) decibels as measured at the property line of the short-term rental unit. In addition, the short-term rental must comply with the City's noise regulations as they apply to residential uses."
§ 6.11.020(C): "No person owning or possessing an animal shall permit such animal to bark, yelp, bray or make other noises in such a manner that, because of the duration or repetition of the noise, a reasonable person would consider an unreasonable intrusion into the quiet enjoyment of their property."
§ 8.28.040: "Any person found guilty of violating any of the provisions of this chapter shall be convicted for a misdemeanor and shall be punished by a fine of not more than one thousand dollars ($1,000.00), or by imprisonment in the City jail for a period of time not to exceed six months, or by both such fine and imprisonment."

How to file a noise complaint in North Las Vegas

Chapter 8.28 does not name an enforcing agency; a violation is a misdemeanor (8.28.040). The City's Police Department page lists (702) 633-9111 for Police Headquarters (2250 Las Vegas Blvd. North, Ste. 300) and for the South Area Command, and the City's Animal Noise Complaints page calls (702) 633-9111 the "North Las Vegas Police Department Dispatch Center"; neither page calls it a non-emergency line or gives a noise-specific number, and we found no City page that routes loud-music or party complaints to a particular channel; noise is not among the report types the Police Department's online E-Police Report accepts (burglary, property damage, vehicle tampering, graffiti, harassing phone calls, lost property and thefts). For barking and other animal noise (NLVMC 6.11.020), the Animal Noise Complaints page says Animal Protection Services first does a welfare check and advises the owner; a second complaint on the same animal or property is sent to mediation at the Clark County Neighborhood Justice Center (mediation.works@clarkcountycourts.us or (702) 455-3898); if the noise continues after mediation, the complainant must record at least 10 minutes of video or audio on at least five separate occasions, time-stamped with name, date, time and location, then call the Dispatch Center at (702) 633-9111 and ask for an Animal Protection Officer, who may ask neighbors for witness statements and route a case report to the City Attorney's Criminal Division. Code Enforcement (702-633-1677, Monday-Thursday 7:00 a.m.-4:30 p.m.) takes requests through its online Request For Service form (https://clients.comcate.com/newrequest.php?id=159), but its page does not list noise among its areas of focus. Worth knowing

(1) The list in 8.28.020 is expressly non-exclusive: the acts are declared unlawful "among others" and "this enumeration shall not be deemed exclusive", so noise outside the examples can still violate 8.28.010. (2) The 11 p.m. to 7 a.m. window in 8.28.020 B and C is a "particularly" clause, not a curfew; the same conduct can violate the chapter at any hour. (3) The construction window (6 a.m. to 9 p.m.) covers any building, street or highway citywide, not only work in residential districts, and has a 5 a.m. start from April 1 to September 30 in declarant-controlled common-interest communities and for projects more than 300 feet from an occupied residential unit; "residential unit" excludes a time share or other unit subject to NRS Chapter 119A (8.28.020 H.2). (4) Exceptions (8.28.020 M): City vehicles on necessary public business; night excavation or repair of bridges, streets or highways by or on behalf of the City, Clark County or the State when daytime work is impracticable; and nonamplified crowd noise at planned student, government, community, sporting and entertainment events or gatherings. (5) Variances (8.28.030): the City Council may grant one for reasonable activities where extraordinary circumstances exist; the application goes to the City Clerk more than 30 days ahead with a $25.00 fee, the hearing is set 15 to 30 days after receipt with newspaper notice at least 10 days before and mailed notice to owners within 300 feet of a stationary activity, and if the Council does not decide within 15 days of the hearing the application is deemed approved. (6) Penalty: misdemeanor, a fine of up to $1,000 and/or up to six months in the City jail (8.28.040). (7) "Excessive noise" is a nuisance activity under the chronic nuisance chapter: three or more nuisance activities on a property in any ninety-day period, or three or more by a person associated with the property on it or within 100 feet of it, make a chronic nuisance (8.80.010, 8.80.020). (8) Vehicles: every motorcycle, motor powered bicycle or motor powered vehicle must have a working muffler that prevents excessive or unusual noise, on public or private property (10.40.060), and 10.40.080 separately bans loud or unnecessary noises that are annoying and discomforting to persons of ordinary sensitiveness on any public street, public place or premises in the city. (9) Short-term rentals must also keep outdoor noise monitoring equipment with at least thirty days of recording capability in common areas such as the pool or spa, backyard, porch or patio, and violations of the short-term rental standards may result in revocation of the business license (17.20.030). (10) The NLVMC applies only inside North Las Vegas city limits; the City of Las Vegas and unincorporated Clark County have their own noise rules.

Document it before you report it

North Las Vegas enforces mostly by audibility, but a log of measured levels still makes a complaint concrete and credible. Take a quick reading with the free online decibel meter — it runs in your browser and records nothing — and check how loud your block is on the North Las Vegas noise map. For time-stamped measurement history you can show a landlord or code officer, the app keeps a log.
