Quiet hours in Rockford

Tiered, not one single window: outdoor amplified music near residential property is banned 11:00 p.m.–7:00 a.m. (Sec. 17-28(c)); amplified sound devices, PA systems, musical instruments, TVs/phonographs, factory whistles, church bells are banned 10:00 p.m.–7:00 a.m. outdoors within 600 feet of any residential or hospital building, or indoors if audible from adjacent residential/hospital property (Sec. 17-28(d)); construction/repair with hammers or power tools banned 10:00 p.m.–7:00 a.m. within 600 feet of residential/hospital buildings (Sec. 17-31); power lawn/garden equipment banned 10:00 p.m.–7:00 a.m. and snow blowers 10:00 p.m.–5:30 a.m. within 600 feet (Sec. 17-32); garbage/yard waste/recycling collection banned 10:00 p.m.–6:00 a.m. citywide (Sec. 17-28(e)); licensees may not run balers, cranes, pneumatic hammers, or derricks before 7:00 a.m. or after 10:00 p.m. (Sec. 17-34).

Decibel limits — or rather, the lack of them

General neighbor noise uses an "unreasonably loud or raucous" nuisance standard plus audibility distances (heard 75+ feet from a device/vehicle on the public way, Sec. 17-28(a); outdoor music audible more than 10 feet from the property near residences, Sec. 17-28(b)) — no general residential dB number. Specific dB limits exist only for: motorboats — 90 dB stationary test (SAE J2005) and 75 dB measured from the shoreline (SAE J1970) (Sec. 17-29); unregistered recreational/off-highway vehicles — 76 dB(A) at not less than 50 feet on business- or residential-zoned property (Sec. 17-30). The city also adopts by reference the Illinois Pollution Control Board property-line sound-emission standards (35 Ill. Admin. Code 901.101 et seq., Sec. 17-25) and state motor-vehicle noise limits (35 Ill. Admin. Code 902.120–902.125, Sec. 17-27(b)).

What the ordinance actually says

Sec. 17-26(a): No person or property owner, shall make, allow, permit, continue, or cause to be made or continued... [a]ny noise which unreasonably disturbs, injures, or endangers the comfort, repose, health, peace, or safety of reasonable persons of ordinary sensitivity, within the jurisdictional limits of the City of Rockford

Sec. 17-28(c): It shall be unlawful to play music outside using a stereo, radio, speaker, bull horn, intercom system or any other sound amplifying device between the hours of 11:00 p.m. and 7:00 a.m. on any property which is abutting or across the street from property used for residential purposes.

Sec. 17-31: It shall be unlawful for any person to use any hammer or power-operated tool for repair or construction purposes between the hours of 10:00 p.m. and 7:00 a.m. within 600 feet of any building used for residential or hospital purposes. Repairs to public service utilities shall be exempted from this section.

Worth knowing

The entire noise article was repealed and re-enacted by Ord. No. 2022-166-O (Aug. 15, 2022), so pre-2022 copies online (e.g., the widely-mirrored 2016 version with old Secs. 17-33/17-35 numbering) are obsolete. Exemptions (Sec. 17-35): emergency-vehicle sirens/bells, fire and burglar alarms, emergency warning systems, train whistles/horns, authorized fireworks, authorized concerts and parades, and anything authorized by a city special-event permit; utility repairs are exempt from the construction-hours rule. Sec. 17-26(b) lists reasonableness factors (proximity to sleeping facilities, zoning, time of day, duration, recurrence). Teeth: any vehicle, boat, or sound device used in violation is declared a public nuisance and subject to seizure/impound (Sec. 17-37) with a $500 administrative penalty plus towing/storage, rising to $750 for a second offense within two years (Sec. 17-42(b)). Animal noise (Sec. 17-33) has unusual evidence rules: a complaint needs a 10+ minute continuous recording, two households complaining, or officer corroboration. Minor scrivener quirks in the current code: Sec. 17-35 misrefers to "this article III" and Municode shows a duplicated Sec. 17-28 node.
